Terms of Service

1. Acceptance

These terms are a contract between you and perfbit, a sole proprietorship based in Bengaluru, India- referred to here as “we”, “our” and “us”.

By creating an account or using the perfbit service (including our website at perfbit.app and our React Native SDK), you agree to these Terms of Service. If you do not agree, do not use perfbit.

If you are using perfbit on behalf of a company or organization, you represent that you have authority to bind that entity to these terms.

2. The service

perfbit provides performance monitoring for React Native applications. The service includes a dashboard for viewing per-build metrics, an SDK for instrumenting your app, and an ingestion API for receiving events.

We reserve the right to modify, suspend, or discontinue any part of the service with reasonable notice. We will provide at least 30 days' notice before discontinuing the service entirely.

3. Your account

You are responsible for maintaining the confidentiality of your API key and account credentials. You are responsible for all activity that occurs under your account. Notify us immediately at hello@perfbit.app if you suspect unauthorized access.

4. Acceptable use

You agree not to:

• Use perfbit to collect or store sensitive personal data about your end users
• Reverse-engineer, decompile, or tamper with our SDK or API
• Circumvent plan limits or share API keys across multiple organizations
• Use the service to transmit malware, spam, or illegal content
• Resell or sublicense the service without our written permission

We reserve the right to suspend accounts that violate these terms without refund.

5. Free trial

New accounts receive a 14-day free trial. The trial enables every feature of the product, subject to limits of 5 apps, 1 million events per month, 90-day retention and a single seat - the Studio plan's higher limits are not included. No credit card is required to start a trial, and nothing is charged when it ends.

At the end of the trial you must select a paid plan to continue using the service. Accounts that do not convert are downgraded: dashboard access ends, and your collected data is retained for 30 days and then permanently deleted.

Our SDK is not switched off remotely when a trial or subscription ends. If your published app still has perfbit installed it will continue sending events, and we will continue accepting them, but you will not be able to view them until you subscribe. To stop the SDK sending data, remove or disable it in your app and ship a new build.

6. Billing and payments

Paid subscriptions are billed in advance, monthly or annually, via DodoPayments. All prices are in USD and exclusive of taxes, which may be added at checkout based on your location.

If a payment fails, our payment provider will retry it over the following days. If it still cannot be collected, your account is downgraded rather than charged again. You remain responsible for any amounts already outstanding.

Annual plans are refundable in full within 14 days of the initial charge and non-refundable after that. Monthly plans can be cancelled at any time; you retain access through the end of the current billing period. We do not offer prorated refunds for unused portions of a subscription. 7. Intellectual property

perfbit and its original content, features, and functionality are owned by us and protected by copyright law. You retain full ownership of your app code and the performance data collected from your app. We claim no rights over your data.

By using perfbit, you grant us a limited license to store, process, and display your performance data solely to provide the service to you.

8. Disclaimer of warranties

The service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the service will be uninterrupted, error-free, or that data will be retained indefinitely. Performance data may be delayed or incomplete in rare circumstances.

9. Limitation of liability

To the maximum extent permitted by law, perfbit shall not be liable for any indirect, incidental, special, consequential, or punitive damages - including lost profits, lost data, or loss of goodwill - arising out of or relating to your use of the service.

Our total liability for any claim under these terms shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Termination

You may cancel your subscription, or delete your account entirely, at any time from your dashboard settings. Deleting your account cancels any active subscription and permanently removes your workspace, apps, and collected performance data. You can export everything first from the same screen. We may terminate or suspend your account immediately, without notice, for violations of these terms or for non-payment.

Upon termination, your right to use the service ceases. Sections 7, 8, 9, and 11 survive termination.

11. Governing law

These terms are governed by the laws of India, without regard to conflict-of-law principles, and the courts of Bengaluru, Karnataka have exclusive jurisdiction over any dispute.

Where you and we both agree to it, a dispute may instead be resolved through binding arbitration on an individual basis rather than as part of a class action.

If you are a consumer resident in the European Union or the United Kingdom, nothing in this section takes away your right to bring proceedings in the courts of your country of residence, or to rely on the mandatory consumer-protection rules of that country. The arbitration and class-action provisions above do not apply to you.

12. Changes to these terms

We may update these terms from time to time. When we make material changes, we will update the “Last updated” date above and notify you by email. Continued use of the service after notice constitutes acceptance of the updated terms.
